Deputies have made history by passing two significant pieces of legislation: the Criminal Procedure Bill and the Criminal Offence Bill.
These reforms, passed on Friday 28 March 2025, represent the country’s most ambitious effort to modernize its justice system by replacing outdated colonial laws.
The new laws aim to create a fairer, faster, and more transparent court system, while also decriminalizing acts such as same-sex relationships and minor public offences.
The reforms eliminate 19th-century regulations imposed during British rule, which critics argue have contributed to discrimination and police abuse.
For instance, vague offences like “public nuisance” and “loitering” will no longer result in jail term, relieving pressure on overcrowded prison systems.
Additionally, torture by security forces is now explicitly prohibited, and suspects must be charged within 72 hours or be released.
Police will also be required to obtain warrants for most arrests, ensuring greater accountability in law enforcement.
